BM SERVICES USA LLC – Terms & Conditions
Effective for all HVAC/R Services: Install, Repair, Maintenance
1. Pre-Payment Policy
Full payment is required before any work begins. No exceptions.
2. Scope of Work
By approving an estimate, the client acknowledges that additional parts or labor may be required once internal system access is gained. Our technicians may only see visible symptoms at the start. Underlying issues may appear during service. If necessary items are declined, BM SERVICES USA reserves the right to leave the job incomplete, and no performance guarantees apply.
3. Late Fees & Legal Action
Payments must be made within 3 calendar days of invoicing.
Unpaid invoices will incur a $250 late fee per unit after day 3.
After 30 days, legal actions including mechanic’s liens (Florida Statutes Chapter 713) may apply.
Clients are responsible for all collection and legal fees incurred during recovery.
4. Warranty & Service Policy
All labor is warrantied for 30 days. Parts are covered per manufacturer terms.
Warranty is void if:
Any unauthorized third party performs diagnostics, services, or modifications.
The system is misused, neglected, or lacks proper maintenance.
Unauthorized third-party intervention results in the immediate and total forfeiture of all warranties, including those for labor, parts, and estimates. Any open balance becomes immediately due, and administrative fees may be added for the cost of inspection or case review.
Protected under the Magnuson-Moss Warranty Act and Florida UCC Chapter 672, this policy ensures BM SERVICES USA’s legal rights are preserved when contractual conditions are breached.
All follow-up work must be performed exclusively by BM SERVICES USA or its authorized technicians.
5. Access to Equipment
Clients are responsible for providing clear, safe, and unobstructed access to all equipment. Failure to do so may lead to delays, rescheduling fees, or service denial.
6. Emergency & After-Hours Services
After-hours, weekend, or night calls are billed at higher rates.
All scheduling and fees are processed via HouseCall Pro.
It is the client’s responsibility to review and approve the terms before confirming service.
7. Refrigerant Charges
Refrigerant use is based on actual measured system need, not label estimates. If the client declines a recharge, no performance warranty will apply.
8. Technical Reports
Reports must be requested in advance and are billed separately. These reports are non-refundable, regardless of service outcome.
9. Preventive Maintenance
Routine maintenance extends system life, improves efficiency, and reduces emergency repair costs. Service visit fees may be waived if the client approves a recommended estimate during a maintenance check.
10. Product Handling and Liability Disclaimer
BM SERVICES USA is not responsible for the handling, storage, or condition of any merchandise or product, including temperature-sensitive goods.
All products must be removed before any equipment intervention.
BM SERVICES USA will not remove or protect products left inside the unit.
We are not liable for product damage or spoilage from delays, power outages, or equipment shutdowns.
This aligns with Florida’s UCC laws and consumer responsibility statutes.
11. Limitation of Liability
BM SERVICES USA is not liable for:
Product loss
Weather delays, access restrictions, or supplier issues
Indirect or consequential damages (including business losses or spoilage)
12. Client Evaluation & Service Rights
BM SERVICES USA reserves the full right to evaluate and approve any service request. Our goal is to serve a select group of serious, aligned clients who match the level of service we are committed to deliver.
We choose our clients. Not every inquiry will be accepted.
Clients with:
A history of payment issues
Negative interactions
Or who fail to meet our standards of conduct and professionalism
…may be denied service at our discretion, without the need for further explanation.
13. Acknowledgment & Acceptance
By requesting or confirming a service from BM SERVICES USA, the client acknowledges and agrees to all terms and conditions stated above.
